This Privacy Policy applies to data collection and security practices of H2Oasis Float Center  LLC, an Oklahoma limited liability company, doing business as H2Oasis (“H2Oasis“, “us“, “our“, or “we“) regarding our products and services, including our website: www.H2oasisfloatcenter.com/ (the “Site“, and collectively, with our products and services, the “Services“). We are committed to protecting the privacy of your information. While this Policy will serve as a default Privacy Policy for those Subscribers without their own Privacy Policy, please be aware that you may be subject to the additional terms of any privacy policy that you may have with individual Subscribers. Subscribers’ Collected Information (as defined below) can be viewed by anyone logged onto Subscriber’s account. This Privacy Policy is in all respects subject to the H2Oasis Visitor Terms.

H2Oasis is committed to protecting your privacy. We will use the information that you provide to us as described below. Except as otherwise described in this Privacy Policy, your personally identifiable information will never be rented, sold or otherwise provided to any third-party without your consent. Whenever you provide personal information or other information about someone other than yourself, you are warranting that you have that person’s consent to provide such information for the purpose specified. We also consider the protection of privacy of children very important and we will not knowingly collect personal data from children under the age of 18 without obtaining parental consent. When we discover that personal information has been collected from persons under 18 years of age – without verifiable parental consent – we will take the appropriate steps to delete such information.

Certain information and/or personal information may be disclosed to third-parties in connection with and as necessitated by our normal provision of services, or in the ordinary course of your activity where there is no expectation of privacy. By using the Site, the Services, or by registering an account and providing your personally identifiable information, you confirm your acceptance of, and agree to be bound by this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Site, the Services, register an account, or input any information. Your acceptance of this Privacy Policy authorizes us to use or disclose your personal information in accordance with this Privacy Policy.

H2Oasis will adhere with the General Data Protection Regulation (the “GDPR“) adopted by the European Union. Namely, at any time, you may, subject to the applicable limitations of the GDPR:

  • Request restriction or, or withdraw your consent regarding, the processing of your personal information.
  • Request access to and rectification of your personal information.
  • Request that your personal information be erased.
  • Request details of the personal information we hold about you.

Any requests should be mailed, or called in, to us using the company information described at the bottom of this Privacy Policy.

2. Collected Information

H2Oasis “Subscriber” is the business or entity that purchased a subscription for the H2Oasis Service and entered into the Software Service Agreement. A “Visitor” is the businesses or individuals considering, scheduling and purchasing products and services from the Subscriber. Subscribers, Visitors, and other users of the Site are collectively referred to as “user” or “you”. When you utilize the Services, we may collect certain information directly from you that you provide to us, as well as information that is automatically or passively collected from other sources, such as from your browser or device. Providing this information is voluntary which we use internally and with HelmBot partners. All information collected while within the H2Oasis Services shall be referred to as “Collected Information“. Collected Information includes any information we may collect directly from what you provide to us, as well as information that is automatically or passively collected from other sources, such as from your browser or device.

Information that you Provide. The information that we may ask you to provide, or the information that you otherwise disclose, in connection with the Services may vary greatly, but is generally limited to names (or other identifier), email, and access credentials.

Purchases. When you make purchases on the Site, and at other times in your use of the Site, we make ask you to provide information which may personally identify you and/or allow us to contact you, such as your name and email address, username and password, billing address, credit card number, applications purchased, date of purchase, and information about your computer and software.

Access Credentials. When you create or sign into your account to use the Services, we use certain tracking technologies, such as cookies, to store your sign-in information.

Device, Usage, and Location Data. When you access the Services, logs used to help us diagnose problems with our server, to administer the Site, and to otherwise provide our Services to you, may automatically collect standard web log entries for each page served, including your IP address, page URL, browser type, and language, access times, referring website addresses, information you search on the Site, date and timestamps associated with Site access and usage, system configuration information, metadata concerning the files that you upload/download, and other interactions with the Site and/or Services. Some of our products may store data locally on your computer (preferences, connection settings, image metadata). Our products contact our servers as part of the activation and deactivation processes, and information entered into the registration dialog is logged on our licensing server, including computer identifying information and the IP address information. Checking for updates to our Services also sends the computer identifying information and the information you entered into the registration dialog.

Other Information. Many electronic devices track real-time location-based information. Some files you share may be embedded with this location information. If you do not wish to share this information, do not upload those embedded files and/or turn off that feature on your camera, or other device.

3. How H2Oasis May Use or Disclose Information

Operation of Services and our Business. The personal information you provide, in combination with other information collected, will be used to operate the Site, to improve the quality of our Site, and to provide you with a better experience. Specifically, it may be used to: (i) provide you with important information about the product or service that you are using, including critical updates, notifications, and product announcements; (ii) diagnose problems with the Site; (iii) provide and improve functionality and user-friendliness of our Site; and (iv) better understand your needs and interests, and personalize and improve your experience. Additionally, in the event H2Oasis sells or transfers some or all of its assets, the information it collects may be disclosed to, and your personally identifiable information may be among those assets transferred.

Communications with you. We may use your information for communications with you, such as for sending confirmation emails, authenticating your purchases, and for marketing of our Services to you. We distribute a newsletter via the email address you provide to us. If you no longer wish to receive this newsletter from us, you may “unsubscribe” by following the instructions in the email.

Security Compliance. We use information to monitor and analyze use of the Services, to reduce fraud, software piracy, and protect our users and customers, and verify a user name and administer your use of the Services.

Legal ComplianceH2Oasis may disclose information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. H2Oasis may also disclose information to law enforcement officers or others, in the good faith belief that such disclosure is reasonably necessary to: enforce our Terms and Conditions; comply with the GDPR; or protect the rights, property, or personal safety of H2Oasis , its users, or the general public.

Aggregated InformationH2Oasis may disclose information in the form of aggregate data regarding user behavior, which does not identify any individual user.

4. Service Providers

This Privacy Policy applies to H2Oasis only. However, as we work with third-parties in connection with the operation of the Services and our business, those third-parties may collect or have access to your information necessary or appropriate for the function and operation of the Services and our business. H2Oasis may share Collected Information with Our Service Providers (as defined below) for such legitimate purposes as: (a) contacting users who have provided contact information on our behalf; or (b) providing and monitoring the Service to ensure the quality of information provided through diagnostics. H2Oasis does not share, sell, rent, or trade any information provided by You or Your Visitors with third-parties for their promotional purposes. H2Oasis works with the following third-parties:

H2Oasis uses Heroku.com for hosting, which in turn uses Amazon. Heroku’s privacy policy can be found hereH2Oasis also uses Amazon hosting to store any information we collected. Amazon’s privacy policy can be found here. We use NewRelic.com for analytics about our server performance. New Relic’s privacy policy can be found here. We use and Authorize.Net and Stripe for our Credit Card processing. Authorize.Net’s privacy policy can be found here. Stripe’s privacy policy can be found here. Collectively, Heroku, Amazon, New Relic, Authorize.Net, Stripe, and their affiliates are referred to as “Service Providers.” We also use mailchimp and clover.

H2Oasis may also provide links to third-party websites, or you may wish to authorize us to connect with different services to perform actions on your behalf. Please be aware that any such links or performance of actions on your behalf are for your convenience only and it is your responsibility to be aware of and comply with the various terms of use and privacy policies of such third-parties. We do not have any control over the privacy policies of third-party websites and are not responsible for the privacy or security practices of any third-party unless otherwise required by the GDPR.

5. Tracking Technologies

H2Oasis employs, or our third-party Service Providers employ, various tracking technologies, such as cookies, web beacons and analytics software, that help us better manage content on our Collected Information by informing us what content is effective. a. Cookies

When you visit the Site, we send one or more “cookies” to your computer or other devices. Cookies are packets of identifying data stored on your computer through your web browser and are used by most websites to help personalize your web experience. Generally, H2Oasis will use cookies to determine if you are signed onto the Site. Some cookies may facilitate additional site features for enhanced performance and functionality such as remembering preferences, allowing social interactions, analyzing usage for site optimization, providing custom content, allowing third-parties to provide social sharing tools, and serving images or videos from third-party websites. Some features on this site will not function if you do not allow cookies. We may link the information we store in cookies to any Collected Information you submit while on our site.

We use both session ID cookies and persistent cookies. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. Persistent cookies enable us to track and target the interest of our users to enhance the experience on our site. You can remove persistent cookies by following directions provided in your Internet browser’s “help” file.

Functional cookies, persistent and session type, store information to enable the core site function of Client ID remembrance to know if You are logged in into the Site.

Analytics cookies allow us to count page visits and traffic sources, so we can measure and improve the performance of our site and our marketing campaigns.

Generally, your web browser is enabled to allow you the ability to manage cookies and other tracking technologies used by websites, including the ability to limit, manage, block and delete. The same may be utilized to manage the technologies’ collection of information and delivery to HelmBot. However, note that blocking or limiting certain of the technologies may impair your ability to utilize or access certain features of the Site (such as keeping you signed in or remembering your preferences).

b. Web Beacons

H2Oasis, or our third-party Service Provider, uses Web beacons alone or in conjunction with cookies to compile information about users’ usage of the Service and interaction with emails from H2Oasis. For example, we may place Web beacons in marketing emails that notify us when you view that email. We use Web beacons to operate and improve the Service and email communications.

H2Oasis may use information from Web beacons in combination with Collected Information to provide you with information about H2Oasis Service and its products and services.

c. Analytics Software

We and our third-party tracking-utility Service Partners use log files on the Service to gather certain information automatically and store it for analytical purposes. This information includes internet protocol (“IP”) addresses, browser type, internet service provider, referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to track and aggregate non-personal information to analyze trends, administer the site, track users’ movements around the Services, and to gather demographic information about our user base in the aggregate.

6. Subscriber’s Customer Collected Information

H2Oasis collects information from Customers under the direction of its Subscribers, and has no direct relationship with the individual Customers whose personal data it processes. Customers should contact the Subscriber directly about any of the Customers’ Collected Information. If a Customer seeks access, or seeks to correct, amend, or delete inaccurate Collected Information the Customer should direct her query to the Subscriber. If the Subscriber requests that H2Oasis remove the Collected Information, we will respond to their request within 30 business days. If you are a Customer of one of our Subscribers and would no longer like to be contacted by one of our Subscribers that use our Service, please contact the Subscriber that you interact with directly.

H2Oasis may transfer Collected Information to third-party Service Providers that help us provide Our Service. Transfers to these third-parties are covered by the provisions in this Privacy Policy regarding notice, choice, and the service agreements with our Subscribers.

7. Public Forums and Subscriber Testimonials

We may provide bulletin boards, blogs, or chat rooms on the Site. Any personal information (“Posts“) users choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send users unsolicited messages. H2Oasis is not responsible for any Posts you choose to submit in these forums. To request removal of your Posts from our blog or community forum, contact us at: [email protected].

H2Oasis posts a list of Subscribers and testimonials on the Site that contain information such as Subscribers’ names and titles. H2Oasis obtains the consent of each Subscriber prior to posting any information on such a list or posting testimonials.

8. Legal Disclosure

We reserve the right to disclose Collected Information to the appropriate third-parties under the following circumstances:

a. As required by law, such as to comply with a subpoena, or legal process.

b. When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

c. To any other third-party with your prior consent to do so.

9. Correcting and Updating Information

a. Subscribers

Subscribers may update or change their registration information by updating their profile settings. Requests to access, change, or delete your Collected Information will be handled within 30 days.

We will retain your Collected Information for as long as your account is active or as needed to provide you Services. If you wish to cancel your account or request that we no longer use your Collected Information to provide you with the Services please contact our Data Protection Officer at the email address listed at the end of this Privacy Policy. We will retain and use your Collected Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

b. Visitors

Visitors may update or change their registration information by updating their profile settings or as directed by the Subscriber. Visitors should contact Subscribers directly to make any requests to access, change, or delete your Collected Information.

We will retain your Collected Information for as long as your account is active or as needed to provide you Services. If you wish to cancel your account or request that we no longer use your Collected Information to provide you with the Services, please contact the Subscriber directly. We will retain and use your Collected Information as necessary to comply with Subscribers’ requests, our legal obligations, to resolve disputes, and to enforce our agreements.

10. Security

H2Oasis utilizes appropriate administrative, technical, and physical safeguards to protect Collected Information. When users log in to the H2Oasis Service using the latest version of Internet Explorer, Firefox, or Safari, Secure Socket Layer (SSL) technology protects Collected Information using both server authentication and data encryption. These technologies help provide safety and security for Collected Information and help to restrict its availability to the user to whom the information belongs and those to whom the user has granted access. H2Oasis hosts its websites in a secure server environment that uses reasonable technology designed to prevent interference or access from outside intruders. Nevertheless, given the possibility of the unlawful interception of information, we cannot guarantee, and you should not expect that your information you provide to H2Oasis will always remain private or secure. Should you suspect any misuse, loss of, or unauthorized access to your Personal Information, you should contact us immediately.

11. Complaints and Disputes

If you have a complaint about our handling of your personal information, please let us know about the complaint and we will attempt to resolve the issue. If we are unable to resolve the issue to your satisfaction and you feel that your rights under the GDPR or applicable law have been infringed, you have the right to seek a judicial remedy. If we become aware of any unauthorized access to your Personal Information, we will inform you at the earliest practical opportunity once we have established what was accessed and how it was accessed.

12. Changes to this Privacy Statement

Please note this Privacy Policy may change from time to time. We will post any changes to the Site, and we strongly encourage you to periodically review this Privacy Policy, most importantly, before you provide H2Oasis with any personal information. Your continued use of the Services after any changes to this Privacy Policy constitutes your acceptance of the revised Privacy Policy. If you do not agree to the changes, please do not continue using the Services.
